Detailed Solution

A. Consolidated Fund of India — Article 266 (1)

Article 266 provides for the Consolidated Funds and Public Accounts of India and the States.

Revenues received by the Government of India, loans raised by it and money received in repayment of loans granted by it form, subject to constitutional exceptions, the Consolidated Fund of India.

An important provision of Article 266(3) is that no money can be appropriated out of the Consolidated Fund of India except in accordance with law and in the manner provided by the Constitution.

B. Finance Commission — Article 280 (3)

Article 280 provides for the constitution of the Finance Commission by the President.

It is to be constituted within two years of the commencement of the Constitution and thereafter at the expiration of every fifth year, or earlier if the President considers it necessary.

The Finance Commission consists of a Chairman and four other members. One of its principal constitutional functions is to recommend the distribution of divisible net tax proceeds between the Union and the States and principles governing grants-in-aid to States.

C. Financial Emergency — Article 360 (2)

Article 360 deals with Financial Emergency.

A Financial Emergency may be proclaimed if the President is satisfied that a situation has arisen whereby the financial stability or credit of India or any part of its territory is threatened.

It is distinct from the National Emergency under Article 352 and failure of constitutional machinery in a State under Article 356.

D. Comptroller and Auditor General of India — Article 148 (4)

Article 148 provides for the constitutional office of the Comptroller and Auditor General of India (CAG).

The CAG is appointed by the President by warrant under his hand and seal and can be removed only in the same manner and on the same grounds as a Judge of the Supreme Court.

To protect the independence of the office, the Constitution also provides that after ceasing to hold office, the CAG is not eligible for further office under the Government of India or any State Government.
