Previous Year Question
Which of the following Bills can NOT be first introduced in Rajya Sabha?
Ordinary Bill
Constitutional Amendment Bill
State Re-organisation Bill
Money Bill
Correct Answer: D
Detailed Solution
Article 109(1) of the Constitution expressly provides that a Money Bill shall not be introduced in the Rajya Sabha. It can originate only in the Lok Sabha.
After being passed by the Lok Sabha, a Money Bill is transmitted to the Rajya Sabha for its recommendations. The Rajya Sabha must return it within 14 days. The Lok Sabha may accept or reject all, some or none of its recommendations.
An Ordinary Bill may generally originate in either House of Parliament. Similarly, a Constitution Amendment Bill under Article 368 may be introduced in either the Lok Sabha or the Rajya Sabha. A Bill concerning State reorganisation under Article 3 may also be introduced in either House, although the recommendation of the President is required for its introduction.
A Money Bill is defined under Article 110. If any question arises whether a Bill is a Money Bill, Article 110(3) makes the decision of the Speaker of the Lok Sabha final.
Thus, the key association is—Article 109 → Money Bill cannot originate in Rajya Sabha; Article 110 → Definition of Money Bill.
