Detailed Solution
According to Article 243ZJ(1) of the Constitution, the number of directors on the Board of a Co-operative Society may be prescribed by the State Legislature by law, but the maximum number of directors cannot exceed 21.
Article 243ZJ is contained in Part IXB—The Co-operative Societies of the Constitution. Part IXB was inserted by the 97th Constitutional Amendment Act, 2011 and came into force on 15 February 2012.
Under Clause (2) of the same Article, the term of elected members of the Board and its Office Bearers is 5 years from the date of election.
Under Clause (3), a maximum of 2 Co-opted Members having expertise in Banking, Management, Finance or a related field may be included in addition to the 21 directors. Such Co-opted Members have no right to vote in an election of the Co-operative Society and are not eligible to be elected as Office Bearers of the Board. Functional Directors are excluded while counting the limit of 21 directors.
