Previous Year Question
A resolution passed under clause (1) of Article 249, shall remain in force for a period not exceeding
One month
three months
Six months
one year
Correct Answer: D
Detailed Solution
Under Article 249(1) of the Constitution, if the Rajya Sabha passes a resolution supported by not less than a two-thirds majority of the members present and voting, declaring that it is necessary or expedient in the national interest for Parliament to legislate on a matter in the State List, Parliament may make a law on that matter.
According to Article 249(2), such a resolution remains in force for the period specified in it, but that period cannot exceed one year. It may be continued for further periods of one year at a time by passing another resolution.
Importantly, six months is not the duration of the resolution. Under Article 249(3), a law made by Parliament on the basis of such a resolution may generally continue to have effect for six months after the resolution ceases to be in force.
