Previous Year Question

The provision for the representation of Anglo-Indian community in the Lok Sabha has been made in the Constitution under:

A.

Article-331

B.

Article-221

C.

Article-121

D.

Article-139

Correct Answer: A

Detailed Solution

Under the constitutional position applicable when this Question was asked, Article 331 was the correct answer. Article 331 provided that if the President was of the opinion that the Anglo-Indian community was not adequately represented in the Lok Sabha, the President could nominate not more than two members of that community to the House of the People.

Although the question uses the expression “representation/reservation,” technically this was not a system of elected reserved constituencies; it was special representation through Presidential nomination.

The distinction from SC/ST reservation is useful—

Article 330 → Reserved Lok Sabha seats for SCs/STs
Article 331 → Nomination-based Anglo-Indian representation

Current Position

This arrangement is no longer operational. The 104th Constitutional Amendment Act, 2019, effective from 25 January 2020, extended legislative reservation for SCs/STs but did not extend the Anglo-Indian nomination provision beyond its seventy-year period under Article 334. Consequently, nomination-based Anglo-Indian representation in the Lok Sabha and State Legislative Assemblies ceased.

Thus—

Position in 2015 → Article 331 → maximum 2 nominated Anglo-Indian members
After 25 January 2020 → special nomination no longer operative
