सेवा प्रदाताओं, डेटा सेंटरों और निगमित निकायों—तीनों के लिए निर्धारित cyber security incidents की सूचना CERT-In को देना कानूनी रूप से अनिवार्य है।

Information Technology Act, 2000 की धारा 70B के अंतर्गत Indian Computer Emergency Response Team (CERT-In) को भारत में cyber security incidents के संबंध में राष्ट्रीय nodal agency बनाया गया है। CERT-In cyber incidents से संबंधित information एकत्र करता है, alerts और advisories जारी करता है तथा response activities का coordination करता है।

Information Technology (The Indian Computer Emergency Response Team and Manner of Performing Functions and Duties) Rules, 2013 के अनुसार service providers, intermediaries, data centres और body corporates को निर्धारित cyber security incidents की सूचना CERT-In को देनी होती है।

Report किए जाने वाले incidents में unauthorised access, malicious software attack, website intrusion, phishing, identity theft, data breach, denial-of-service attack, attacks on critical systems और network अथवा application को प्रभावित करने वाली अन्य cyber घटनाएँ सम्मिलित हो सकती हैं।

वर्तमान स्थिति: CERT-In द्वारा 2022 में जारी directions के अनुसार service providers, intermediaries, data centres, body corporates और government organisations को सूचीबद्ध cyber security incidents की जानकारी घटना का पता चलने अथवा उसकी सूचना मिलने के छह घंटे के भीतर CERT-In को देनी होती है।

इन entities को Information and Communication Technology systems के logs को सुरक्षित रूप से 180 दिनों तक रखना तथा उन्हें भारतीय jurisdiction के भीतर बनाए रखना भी आवश्यक है। CERT-In द्वारा माँगे जाने पर ये logs उपलब्ध कराने होते हैं।
