Previous Year Question

Who among the following is not included in the Union Executive of India?

A.
Prime Minister
B.
Vice-President
C.
President
D.
Chief Ministers of the States

Correct Answer: D

Detailed Solution

The provisions relating to the Union Executive are contained in Part V — The Union, Chapter I — The Executive of the Constitution of India.

Article 52 provides for the President of India, while Article 53 vests the executive power of the Union in the President. The same Chapter provides for the Vice-President under Article 63.

Further, Article 74 provides for a Council of Ministers headed by the Prime Minister to aid and advise the President in the exercise of his functions. Article 75 deals with the appointment of the Prime Minister and other Union Ministers and other provisions relating to them.

In contrast, a Chief Minister belongs to the State Executive, not the Union Executive. Under Part VI — The States, Article 163 provides for a Council of Ministers headed by the Chief Minister to aid and advise the Governor of a State.

Important fact: The constitutional chapter dealing with the Union Executive also provides for the Attorney-General for India under Article 76, in addition to the President, Vice-President, Prime Minister and Council of Ministers.
